These disclosures apply to our Site, listings, communications, and services to the fullest extent permitted by law.

A) Agency & Non-Ownership

Podium generally acts solely as an agent for property owners. Podium does not own properties advertised or managed unless expressly stated. Nothing on the Site shall be construed as Podium assuming the role of landlord, lessor, or owner.

B) No Warranty of Habitability / Condition

Property information is provided based on owner representations and available information. Podium makes no warranties, express or implied, regarding habitability, safety, fitness for a particular purpose, building systems, or code compliance. Prospective tenants should conduct their own due diligence and inspections.

C) Listings, Availability, and “No Reliance”

All listing information is deemed reliable but not guaranteed and is subject to errors, omissions, price changes, prior rental/withdrawal, and owner approval. Users should not rely solely on Site information and must verify material facts independently.

D) Maintenance & Repair Coordination Disclaimer

Podium may coordinate maintenance and repairs on behalf of owners. Unless expressly stated, Podium does not perform construction or repair services. Contractors and vendors are independent third parties. Podium is not responsible for work quality, delays, defects, cost overruns, injuries, or damages arising from vendor performance.

E) Access / Entry

Where permitted by law and the lease, access to a unit may be required to inspect conditions, perform repairs, or address emergencies. Access depends on lawful notice requirements, tenant cooperation, and building rules. Podium is not liable for inability to access a unit or delays due to access constraints.

F) Emergency Response Limitation

Podium is not an emergency service provider. In emergencies, call 911 and/or appropriate utility providers. While Podium may attempt to respond to urgent issues, response times cannot be guaranteed. Podium is not liable for damages resulting from delayed response, inability to access, vendor unavailability, or circumstances beyond our control.

G) Security Disclaimer

Podium does not guarantee the security of any building, unit, or neighborhood and is not responsible for criminal acts, theft, vandalism, or third-party misconduct. Tenants and owners are encouraged to maintain appropriate insurance.

H) Applications, Screening, and Owner Approval

Submitting an application does not guarantee approval or housing. Approval decisions are based on owner criteria and applicable law. Screening may include credit, background, income, and rental history verification. Podium may facilitate screening through third parties, including DoorLoop and integrated providers, and is not responsible for their availability or practices.

I) Application Fees & Deposits

Any application fees and deposits will be handled in compliance with applicable New York law and disclosed during the application process. Fees may be non-refundable except as required by law or as expressly stated in writing.

J) Payments and Transaction Disclaimer

Payments may be processed via third-party platforms. Podium is not a financial institution and does not guarantee processing availability or protection from fraud, misdirection, or unauthorized activity. Always verify payment instructions directly with Podium using trusted contact information.

K) Owner–Tenant Disputes

Podium may act as an intermediary for communications but is not responsible for disputes between owners and tenants, co-tenants, neighbors, or third parties. Rights and obligations arise from the lease and applicable law.

L) Force Majeure

Podium is not responsible for delays or failures caused by events beyond reasonable control, including severe weather, utility outages, building system failures, labor disputes, vendor shortages, governmental actions, or public health emergencies.

M) No Guarantee of Outcomes

Podium does not guarantee tenant placement, rent levels, timing, financial results, investment outcomes, or uninterrupted services.

N) Limitation of Damages (Services / Website)

To the fullest extent permitted by law, Podium shall not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages. Any liability, if established, shall be limited to fees paid to Podium for the specific service directly giving rise to the claim during the three (3) months preceding the event giving rise to the claim, unless prohibited by law.

O) Reservation of Rights

Podium may modify listings, Site content, and procedures at any time and may decline service where permitted by law.
